2. General Business; Not Intended for Minors
The Site is intended for a general business audience and is not directed to individuals that are considered minors who are not eligible under state law to use our services. Coya does not knowingly collect personal information from individuals considered minors under applicable state law. If you are under 18 years of age, you may not use the Site. If we learn that we have collected information from an individual under age 18, we will take steps to remove that information as quickly as possible unless permitted by applicable state law.
3. What Information is Collected and How
Coya may collect both personally identifiable information (“PII”) as well as non-personally identifiable information (“Non-PII”) when you visit the Site or contact us via the Site.
3.1. Personally Identifiable Information. PII means information that would allow a third party to identify or locate a particular person. PII includes, without limitation, your full name, email address, zip code, telephone number, birth date, and credit card number. Coya only collects PII if that information is voluntarily provided by you.
3.2. Non-Personally Identifiable Information. Non-PII means anonymous information that does not allow a third party to identify or locate a particular person. You can visit the Site to read information about the Site and the services offered without revealing any PII. However, during your visit to the Site, Coya may collect Non-PII such as the activity of your browser when you are viewing the Site; your site path during your visit to the Site; demographic data; the amount of time you spend on the Site and general information regarding your Internet service provider and host. The Non-PII may be collected by Coya in several ways.
3.3 Logging of Your Activities on the Site. When you access the Site from a computer, mobile phone or other device, Coya may collect information from that device about your browser type, location, and IP address (the number assigned to computers on the Internet), etc. Coya may also collect anonymous “traffic data” information that does not personally identify you, such as, without limitation, the pages you visit, the length of your visit, your referring/exit pages, and your clickstream activity and the actions you take while using or visiting the Site.
3.4 Cookies. Coya may use “cookies” to enhance your use of the Site and to monitor your activity during your visit(s) to the Site. Cookies are text files placed in your computer’s browser to identify your Internet browser and to store your preferences. You can remove or block cookies by programming your Internet browser, but in some cases that may impact your ability to access certain portions of the Site.
3.5 Beacons. Coya may also use “web beacons,” clear.gifs, or similar technologies, to track the activity and flow of your visit(s) to the Site. “Web beacons” and clear.gifs are small pieces of code placed on a web page to monitor the behavior of and to collect data about the visitors to that page.
4. Information Collected by Third Parties
Coya may use the services of third parties for various purposes, including, without limitation, to provide Coya with data collection (such as impressions, clicks, date and time of impressions and clicks, pages viewed, amount of time spent on certain pages or engaged in certain activities, browser type and operating system, and other general clickstream information), user traffic activity, reporting and ad response measurement, and to deliver advertisements and marketing messages. These third parties, or Coya on their behalf, may use their own cookies to monitor your activity during your visit to and/or use of the Site.
5. Coya’s Use of PII and Non-PII
5.1 Coya may use and disclose the User Information you share with Coya to manage your account, to fulfill your requests for products, programs and services, to respond to your inquiries about Coya’s offerings, to respond to your comments or requests for information, to improve the services that Coya offers to its users, to offer you other Coya products, programs or services that Coya believes may be of interest to you, to enforce the legal terms that govern your use of the Site, and for the purposes for which you provided the information. Coya may transfer your PII to third parties to whom you ask us to send such information under a written authorization and release. Coya may use and disclose your PII to conduct research or allow others to do so, but only if you provide written consent to the use of such information for this purpose.
5.2. Coya will not rent, share, or sell the PII you share with us to third parties for marketing purposes. Coya may share your PII with third parties for the purpose of assisting Coya with the management, operation or administration of the Site and associated services; the analysis of the performance of the Site; and the provision of Coya products and services (including, without limitation, the processing and serving of email and other electronic communications).
You may request your information to be deleted from Coya’s records, but please note that even if you have requested that your information be deleted, Coya may retain a record of certain information as required by law and not delete it (or to keep this information for a certain time, in which case we will comply with your deletion request only after we have fulfilled such requirements). When we delete your User Information, it will be deleted from the active database, but may remain in our archives and we may also retain de-identified information about your use of our Site and the services. Once we disclose your User Information to third parties as permitted, we cannot access that information any longer and cannot force the deletion or modification of any such information by the receiving parties to whom we have made those disclosures.
Coya may disclose the User Information it collects on the Site under the following circumstances:
5.5. If Coya sells all or a part of its business or makes a sale of all or a material part of its assets or is otherwise involved in a merger or transfer of all or a material part of its business, then as part of the applicable transaction, Coya may transfer your User Information to the party or parties involved in the transaction. Coya may also share and/or transfer your User Information to any or all of its affiliated entities (such as any subsidiary or parent).
6. Data Security
Coya has in place physical, electronic and operational security methods to help protect against unauthorized access to your User Information. Despite our best efforts to protect your User Information, no transmission over the Internet and no data storage method can be guaranteed to be safe 100% of the time. The User Information made available through the services may be subject to protection under applicable privacy and security laws, including the Health Insurance Portability and Accountability Act ("HIPAA"), and in such instances shall be maintained, used and disclosed in accordance with such applicable laws to the extent required. If you authorize disclosure of your information by Coya to other third parties, different privacy and security standards may apply to the third party and their use and disclosure in that context. Coya does not guarantee that its security measures or those of any third parties will not be circumvented or breached or that your User Information will not be accessed by a third party that is not authorized by Coya. Coya is not responsible, and assumes no liability, for any direct or indirect damages as a result of such circumvention or breach by any third party.
